Bunnell man sentenced to life in prison in child sex case

A Bunnell man was sentenced to life in prison plus an additional 30 years after being found guilty of child sexual abuse Wednesday, according to the State Attorney’s Office.

Thomas Donald Underwood, 32, pleaded no contest to seven counts of sexual battery on a child and one count of lewd or lascivious molestation. The judge sentenced him to 30 years for the seven sexual battery counts and life in prison for lewd or lascivious molestation.

Underwood committed the crimes during the mid-’90s, but the victims did not report the abuse for 16 years, the State Attorney’s Office said.

Jeezzz, 43 years ago, when I was 17, I convinced my 14 year old cousin to pull her pants down so I could get a look (I was a virgin at the time). Does this mean that I now have to go to Cuba to avoid any possibility of prosecution?

Boy Lem,wouldn't have admitted to that one!

In any event if we take "mid nineties" to be say 1997 then this person would have been age 15 at the time.
Is that correct?

All hetro males are sex offenders. John Law gets a few of us, and, here we have this poor then 15 year old sentenced with Life in Prison for simply exercising his biological prerogative. No info on the case, but unless the "victim" was under 9 years of age, what's the big deal. In these cases, I always recall the scene in Raging Bull, where Jake LaMotta consorts with apparently legal women at his bar. Next scene is a court room with a pig-tailed victim describes her violation and degradation.

If hes 32 now, then he would be underage himself. Thats the problem with our one size fits all sexual offender laws. If he were 50 abusing 14 year old throw him under the prison for life, but did ANYONE take ages into account here. Lems right, it would help to know the ages of the victims at the time. Noe if you want to get him for regular sexual assault, fine, but the minor stuff my be a little extreme given ages

If the dates and defendant's age are correctly reported, this sentence is an outrage.

2014 - 32 = 1982 earliest possible year of defendant's birth

2014 - 16 (reporting delay) = 1998 latest possible year offense committed

1998 - 1982 = 16 maximum possible age of defendant at time of offense

This makes the original charges in Christian Fernandez case look trivial by comparison.

You can easily find a case

You can easily find a case every week where a law enforcement or court official decides to prosecute juveniles for trivial sexual activity in the name of "public decency". As Lem stated, a lot juveniles could be subjected to rape charges after consensual sex with another minor under 17 because "an underage male or female cannot give consent". We are told to ignore the fact that each was as willing a participant as the other.

However, searching the internet, I found that he was arrested for DUI Hit and Run two years ago.
